    53 year old tool

    A PERTH doctor is unable to recover his $200,000 Lamborghini after it was seized by police who caught his mechanic driving it at speeds up to 70km/h over the limit.

    The mechanic was allegedly clocked driving the luxury vehicle at more than 160km/h in a 90km/h zone in Perth's east yesterday.

    The doctor who owned the car had left it in the care of the garage where the mechanic worked.

    Under Western Australia's anti-hoon laws, police can impound any car exceeding the speed limit by more than 60km/h, even if it is not the property of the driver.

    Despite an application by the car's owner, the 2006 yellow Lamborghini Gallardo will be impounded for 28 days in line with the state's hoon legislation.

    Police said they had not released the car early because the strict criteria of the anti-hoon laws did not permit it, unless the WA police commissioner gave special dispensation.

    Police Minister Rob Johnson said he sympathised with the owner but that the law acted as a strong deterrent to hoons.

    "I have some sympathy for him but it's a situation that he has to take up with the garage owner,'' Mr Johnson said today.

    "It's not something that I'm prepared to change the law for, simply because somebody who owns a Lamborghini does not have that car for 28 days.''

    WA police Assistant Commissioner for Judicial Services Wayne Gregson said there was nothing police could do because "our hands are tied''.

    He said the police commissioner was the only person entitled to allow a car to be released early.

    The Lamborghini's owner did not have extraordinary circumstances which met the criteria for the car's early release.

    "We try to be fair, without favours, so whether it's a Lamborghini or whether its a Kingswood or a Holden Commodore, we judge it fair, case by case,'' Mr Gregson said.

    "This case did not meet the grounds of an extraordinary hardship.''

    A 53-year-old man has been charged with being a hoon in a client's car.

    It is the second incident involving the seizure of a luxury car to come to media attention in WA in the past six months.

    In July, Australian Financial Review motoring writer Rod Easdown was clocked driving a $470,000 Ferrari at 231km/h on a country road near the wheatbelt town of Toodyay.

    He was fined $1900, ordered to pay $114 in court costs and lost his licence for six months for driving the Ferrari at more than double the 110km/h limit.

    The car's owner, Patrick Nugawela, has hit out at the rejection of his application to have the Lamborghini released.

    Dr Nugawela, who has a practice in Perth's northern suburbs, likened the anti-hoon laws to WA's mandatory sentencing provisions for attacks on police and public officers.

    He said he had been persecuted for an alleged offence in which he played no part.

    "If that person (the driver) gets exonerated, I don't have the benefit of that,'' Dr Nugawela told ABC radio.

    "I have basically been subjected to mandatory sentencing without trial.''

    No doubt a compensation suit will be coming the mechanics way...

    That sucks for him... but thats fair I guess.

    Old news....happened 2 days ago

    I am surprised that he managed 160 on Reid Highway. I know it was a Lambo...but everyone sits 10 below the limit and hogs the right lane. It is a shit road.

    IMO, give the Lambo back to it's owner and confiscate the vehicle/s of the mechanic***. The owner is not at fault, why should he waste his time attempting to claim compo?

    Whilst the car confiscation laws (or "hoon" laws to supposedly be politically correct) are great in theory, but there are some major flaws.

    PV if you were on a semi open road in a car that happily did 100km/h in 3rd and you have another 3 gears to go through, what do you do? I'd at least try 4th no matter how old I was

    We're talking about a mechanic (insert car freak here) who had the chance to drive a car that he normally wouldn't. It doesn't matter what age you are you're gunna do it. Age has nothing to do with it. Yes he is a tool for doing it but honestly PV that's like saying at his age what was he thinking wanting to have sex.

    A tool is a tool at any age.

    And yes there should be a provision in the law to take the offenders car instead of the car they were driving in cases like these. It would be different if the guy lent him his car and told him to go for it but he left it at his mechanics. You know they take it for a test drive sometimes but not at those speeds.

    FYI: Mechanic owns a prestige service centre specialising in these kinds of cars. Driving a Lambo would not be anything unusual for him.

    Police Minister Rob (sucks) Johnson has done a backflip once again.

    2 days after he refused to amend the laws. There is now the provision to substitute the car for the offender's car.

    But regardless of that, it's pretty unjust and ignorant of the police commissioner to support it. Obviously the commissioner is a tool himself. Oh and the laws are obviously flawed...
    This was bound to happen eventually.

    A little update.

    Turns out the claimed 160kph by Police was an estimate. This really restores my faith in the WA police force, or at last the traffic section.

    Lambo was taken to Barbagallo Sport today by Police in an attempt to retrieve data from the computer.

    The mechanic appears in court next week. My bet is he walks away.
